Cooperation and Information Sharing Protocol was signed between Personal Data Protection Authority and the Competition Authority. (26.10.2023) (30.10.2023)

A large number and a wide variety of products/services which support digital economy are developing with the technologies based on data. However, processing of personal data increasingly by big data technologies may raise significant concerns in terms of competition and protection of personal data because strategies of undertakings can be designed and/or implemented in a way that harms the privacy of personal data as well as the establishment of effective competition. This relationship, which affects both competition law enforcement and data protection law enforcement has made cooperation between the relevant authorities inevitable.

Depending on the reasons explained, a Cooperation and Information Sharing Protocol was signed between the Personal Data Protection Authority and the Competition Authority in order to ensure an active and effective regulatory environment. Within the scope of the Protocol, two authorities have agreed on carrying out work for active cooperation such as:

  1. To carry out joint work in developing areas that are within the scope of the responsibility of both authorities and which may cause irreparable harm if not intervened quickly and effectively,
  2. To increase awareness among users in terms of protecting personal data and competition, especially in digital markets and publish reports in cooperation in order to give  a common message to undertakings regarding practices that concern both fields of law,
  3.  To organize joint presentation and discussion programs within the scope of the Personal Data Protection Authority's traditional "Wednesday Seminars" and/or the Competition Authority's "Thursday Conferences",
  4. To organize trainings where relevant authorities share their expertise and experience in their fields of duty,
  5. To discuss common issues in national and/or international events organized and/or attended by the relevant authorities, and support these events on issues within the authorities' own fields.

The protocol and the work mentioned above aim to establish effective competition in the sector and strengthen consumers' control over their personal data.
