The investigation conducted per the Competition Board (the Board) decisions dated 07.11.2024 and numbered 24-45/1055-M, dated 12.12.2024 and numbered 24-53/1169-M about Antalya Tarım Üretim Danışmanlık ve Pazarlama AŞ (ANTALYA TARIM), Gautier Tohum Üretim Dağıtım Sanayi Ticaret Ltd. Şti. (GAUTIER), Metgen Tohumculuk Sanayi ve Ticaret Ltd. Şti. (METGEN) and AD Rossen Tarım Sanayi ve Ticaret AŞ in liquidation (AD ROSSEN IN LIQUIDATION), which are operating in hybrid industrial gherkin seed and hybrid vegetable and fruit seeds markets, to determine whether they violated article 4 of the Act No. 4054 on the Protection of Competition (the Act No. 4054) has been concluded. 

While the investigation process was ongoing, Bayer Tohumculuk ve Tarım Ltd. Şti., Hazera Tohumculuk ve Ticaret AŞ, HMCLAUSE Tohumculuk Tarım Sanayi ve Ticaret AŞ, Multi Tohum Tarım Sanayi ve Ticaret AŞ, Nunhems Tohumculuk AŞ, Rijk Zwaan Tarım Ticaret Ltd. Şti., Sakata Tarım Ürünleri ve Tohumculuk San. ve Tic. Ltd. Şti., Semillas Fito Tarım Sanayi ve Ticaret AŞ, Syngenta Tarım Sanayi ve Ticaret AŞ, Vilmorin Mikado Tohumculuk AŞ, Yüksel Tohum Tarım Sanayi ve Ticaret AŞ and Rito Tohum AŞ applied for settlement. As a result of the settlement processes conducted about the undertakings in question, 25% reduction was applied to administrative fines since the said 12 undertakings admitted that they violated article 4 of the Act No. 4054 by exchanging competitively sensitive information and also Nunhems Tohumculuk AŞ and Rijk Zwaan Tarım Ticaret Ltd. Şti. admitted that they violated article 4 of the Act No. 4054 by determining sales prices together and the investigation was concluded with settlement procedure.

At the end of the investigation process, it was decided in the meeting of the Board dated 16.03.2026 that, of the parties to the investigation, ANTALYA TARIM, GAUTIER, METGEN and AD ROSSEN IN LIQUIDATION violated article 4 of the Act No. 4054 by means of exchanging competitively sensitive information and therefore the four undertakings shall be imposed administrative fines, with the decision numbered 26-10/325-125.

Within this scope, administrative fines amounting to a total of 49.048.337,02 TL were imposed as follows:

• 44.608.467,01 TL to ANTALYA TARIM, 
• 736.566,84 TL to GAUTIER,
• 3.360.943,75 TL to METGEN and
• 342.359,42 TL to AD ROSSEN IN LIQUIDATION

Under the scope of the investigation conducted about the undertakings operating in hybrid industrial gherkin seed and hybrid vegetable and fruit seeds markets, totally, 188.921.100,24 TL administrative fines were imposed.

The investigation of the Authority about field crops seeds is currently ongoing.
