The Competition Board (the Board) concluded the preliminary inquiry conducted about the claim that TOSB Automotive Supply Specialized Organized Industrial Zone and its members violated article 4 of the Act No. 4054 on the Protection of Competition (the Act No. 4054) by means of no-poach agreements regarding the labor sector and/or exchanging competitively sensitive information.

As a result of the examinations made, it was considered that sufficient suspicion rose that the undertakings operating in automotive supply sector entered into gentlemen’s agreements not to hire each other’s employees and engaged in the exchange of competitively sensitive information concerning employee renumeration and other conditions of employment through the meetings held under the body of TOSB Automotive Supply Specialized Organized Industrial Zone and Automotive Suppliers Association and various communication instruments. As a result of the information and documents obtained and examinations and assessments made during the preliminary inquiry process, it was concluded that the suspicions that the practices in question restricted competition are serious and sufficient; accordingly, it was decided, with the decision of the Board dated 13.08.2026 and numbered 26-29/831-M that an investigation shall be initiated according to article 41, paragraph one of the Act No. 4054 about the following undertakings which operate in the automotive supply industry
