An investigation has been initiated about the allegations that 29 producers and dealers operating in the production and sale of orthopedic and neurosurgery products as well as four associations of undertakings, of which those are members, have violated article 4 of the Act No. 4054 on the Protection of Competition by means of acting jointly to prevent the provision of goods to the public at the prices specified in the Health Implementation Communiqué and increase prices.

Under the scope of the examination conducted, findings were obtained that in addition to the orthopedic and neurosurgery products, suppliers of arthroplasty and arthroscopy products acted jointly to fix prices and to restrict the amount of supply to implement the fixed prices; the fixed prices were applied to all hospitals without making a distinction between public and private hospitals. With the suspicion that decisions and actions of undertakings and associations of undertakings aiming at price fixing and restriction of supply might be considered as a violation under the scope of article 4 of the Act No. 4054, it was decided to initiate an investigation according to the decision dated 12.03.2026 and numbered 26-09/285-M.
