Investigation launched on NETFLIX, DISNEY+, EXXEN, BLUTV, AMAZON and GAİN (17.3.2025)

The Competition Board concluded the preliminary inquiry conducted into the allegation that the Act no 4054 on the Protection of Competition was violated by undertakings providing subscription-based on-demand video services aimed at broadcasting creative production content such as movies and series.

In its meeting of 27.02.2025, the Competition Board found that the information and documents acquired and the observations made during the preliminary inquiry were significant and sufficient, and took the decision numbered 25-08/185-M to launch an investigation on

  1. the economic entity comprised of the undertakings Netflix Inc., Los Gatos Turkey Yayın Hizmetleri AŞ, Los Gatos Turkey Medya Eğlence Ltd. Şti. and Los Gatos Turkey Yönetim Destek Hizmetleri Ltd. Şti. (NETFLIX),
  2. the economic entity comprised of the undertakings The Walt Disney Company Medya Eğlence ve Ticaret Ltd. Şti. and Disney XD Televizyon Yayıncılık AŞ (DISNEY+),
  3. Exxen Dijital Yayıncılık AŞ (EXXEN),
  4. BluTV İletişim ve Dijital Yayın Hizmetleri AŞ (BLUTV),
  5. the economic entity comprised of the undertakings Amazon.com Sales, Inc, Amazon.com Services LLC, Amazon Seller Services Private Limited, Amazon Digital UK Limited, Amazon Turkey Perakende Hizmetleri Ltd. Şti and Amazon Turkey Video Dijital Yayıncılık AŞ (AMAZON),
  6. Gain Medya AŞ (GAİN),

in accordance with Article 41 the Act no 4054 on the Protection of Competition, in order to determine whether they violated the same Act.

The investigation launched will examine whether

  • NETFLIX violated Article 6 of the Act no 4054 by abusing its dominant position through conduct including, i) imposing exclusivity conditions under the licensing agreements for the content on the platform on producers/distributors/copyright owners and ii) on persons in the talent pool such as actors, directors and screenwriters, and iii) discriminating between the producers operating in Türkiye and/or persons in the talent pool such as actors playing parts in the original content, favoring its own original productions to the disadvantage of those by independent producers on the platform, etc.
  • NETFLIX, DISNEY+, EXXEN, GAİN, AMAZON and BLUTV violated Article 4 of the Act no 4054 through the exclusivity agreements they signed with content creators including producers and distributors and/or talent including actors, directors, screenwriters, as well as through other agreements and practices with a restrictive effect on competition.
