The Competition Board Has Revised Ferrero's Nut Purchase Commitments (6.11.2025)

Within the scope of the application made by Ferrero, the Competition Board has made a change to the commitments imposed to Ferrero within the scope of the competitive problems in the nut market in Türkiye specifically for the year 2025. The obligation for the firm to purchase at least 45,000 tons of in-shell nut during September - December period each year has been revised only for the year 2025 due to the decrease in yield and quality problems. The Board has updated the said commitment tonnage downwards to be valid only for the year 2025. Ferrero have to purchase at least 30,000 tons of in-shell nut during September - December period in 2025. 

Other existing commitments also continue

Under the scope of the commitments, which became binding with the decision of the Competition Board dated 7 March 2024 and covers 2024-2026 period, the following obligations of Ferrero continues:

  • Not to purchase nuts below intervention reference price
  • Not to exceed the purchase of 100,000 tons of in-shell nut during the season
  • Make a minimum purchase during September - December period each year

The impact of the revised decision on the sector

According to the Competition Board, this limited and temporary revision, which is made due to losses in yield and quality, protects the competitive balance in the market and aims to prevent producers from being harmed and support the stability of the sector.  

The sanctions are clear: Daily fines may be imposed

In case of noncompliance with the revised commitment or any of other commitments, the Board will impose daily administrative fines to Ferrero during the period it does not comply with the commitments. This sanction, which is stipulated in the Act and which becomes more severe as the duration of noncompliance with the commitments extends, aims to ensure that undertakings which choose to terminate the investigation with commitments, like Ferrero, continue to adhere to the commitments.
