Chief Legal Advisor: Ümmü Duygu Batur
The main duties of the Office of the Legal Advisor are as follows:
- To provide legal consultancy services for the Office of the President, as well as for the Offices of the Vice-Presidents, for Departments and for other service units with the approval of the President.
- To represent the Authority in order to follow, defend and settle, before judicial and administrative bodies and enforcement offices, all transactions the Authority is a party to as well as all any conflicts involving the Authority.
- To make proposals for the withdrawal of legal suits and execution proceedings for which litigation or appeal before superior courts would offer no benefits.
- To make proposals for the peaceful settlement of conflicts which are not yet brought before judicial bodies by granting a right or renouncing a benefit.
- To take legal action to protect the interests of the Authority and prevent conflicts in a timely manner, to provide assistance in order to ensure that agreements and contracts are made in accordance with these principles.
- To conduct legal analyses which would provide assistance to the Board in executing its duties, to make reports to the President concerning the stages of lawsuits where necessary.
- In coordination with the relevant division, to keep an archive of the court decisions related to the purview of the Authority, to allow common access to these decisions by transferring them to the Authority database
- To provide personnel support for on-site inspection in case of a request.
- To make all required notifications related to the application of the Act and to monitor the execution of the transactions specified in these notifications in cooperation with the relevant divisions.
- To prepare the drafts concerning the amendments to be made to the Act as well as regulations, communiques and other legislation to be issued by the Authority and the amendments to be made therein by taking the opinion of the relevant institutions and departments; to publish the relevant legislation and ensure that it is updated.
- To carry out the necessary work to harmonize with the Acquis Communautaire regarding the issues under the scope of the Act; to follow, analyze and keep in the Authority’s database the developments in the legislation in other countries, and present proposals.
- To coordinate with other departments for giving opinions regarding the necessary amendments to be made to the legislation and enforcement concerning competition law in other sectors and institutions, to monitor such legislation and enforcement, and to present proposals.
- To monitor, analyze and evaluate the amendments to the legislation, which may affect competition in markets for goods and services as well as the enforcement of the Authority’s legislation, to carry out studies and present proposals about the necessary amendments to the Act, the secondary legislation issued according to the Act and the legislation which other agencies and institutions are obliged to implement.
- To evaluate and give opinions regarding in-house regulatory drafts coming from other units.
- In order to solve the likely hesitations in the implementation of the regulations made, to give opinions by taking into account the relevant departments’ opinions and suggestions or announce those opinions in the form of a circular with the President’s approval, where necessary.
- To evaluate and give opinion about the legislation in force or draft legislation coming from other agencies and institutions.
- To coordinate opinions sent by the internal units to other agencies within the framework of regulations and to save them in the Authority’s database.
- To make regulatory impact analysis, in coordination with other departments, regarding draft legislation.
