The main duties of the Department of Decisions are as follows: 

  • To prepare the agenda of the meeting including the subjects which the President deems appropriate for putting on the agenda, to submit the agenda and the reports and attachments related to the subjects on the agenda as well as relevant opinions and assessments, if any, to the members of the Board and to those concerned before the meeting and to make up the incomplete parts in cooperation with the relevant departments. 
  • To make the necessary proceedings related to the meetings of the Board with agenda, oral hearings and announcement meetings, to prepare minutes of the meetings and keep necessary records. 
  • In order to provide integrity and consistency in Board decisions and policy, to prepare written and/or oral opinions for the Board about the matters to be discussed in the agenda of the Board. 
  • In case the file to be discussed within the scope of the agenda requires, to give opinions within the framework of institutional legislation, Board decisions in the past and their effects, the source legislation and enforcement, court decisions in Turkey and the relevant doctrine, to get support from experts outside the Authority, if needed. 
  • In case there is substantial incompleteness in formal components of reports, annotations or proposals discussed within the scope of the agenda as well as in reports and opinions submitted to Board members, to inform the Board by written findings. 
  • To prepare the drafts of Board decisions within the frameworks of format, contents and periods provided by the Act and secondary legislations, to control the decision drafts in terms of format and content finally before opening to signature for the Board members.
  • To provide assistance in preparing the drafts of dissenting/different vote letters of Board members upon request. 
  • To carry on the correspondence of the Board, to make archives related to decisions and correspondence in coordination with the departments and to keep them for the periods laid down in the regulations of the Authority. 
  • To classify reasoned professional final decisions, to announce precedential decisions and matters related to principles, to prepare reports and other publications about its field of duty and to save the relevant information in the database of the Authority. 
  • To ensure that undertakings are monitored regularly about whether they fulfill the obligations imposed in Board decisions in coordination with relevant departments. 
  • In case the Authority requires that the effects of the Board decisions on the economy or the relevant sector be analyzed, to coordinate the necessary departments and supervise the preparation and submission to the Board of the necessary studies/reports in a timely fashion.
  • To evaluate the objections to the Board decisions on the grounds that there are material mistakes, to submit the findings made ex officio or as a result of an objection. 
  • To make the amendments requested by Board members in draft Board decisions and submit each page of decision records and attachments for the signature of each member present in the meeting, to send them to the relevant departments after enclosing dissenting vote letters for the necessary actions to be done.
The President may assign one of the Board members to coordinate the activities of this Department.
