Supervision and Enforcement Department- II

The main services, which are within the framework of performing the duties given to the Board and the Authority by the Act in line with the founding purpose, are executed primarily by Supervision and Enforcement Departments. The main duties under the responsibility of each Supervision and Enforcement Department are as follows: 

  • For enforcing the provisions of the Act no 4054, to carry out initial examination, preliminary inquiry, investigation, preliminary examination, final examination, exemption examination, on-site inspection within the framework of procedural provisions of the Act, and to prepare a report or an information note about the results of the examinations. 
  • To send the necessary notifications to the addressees within the periods and procedures determined in the legislation, to save the records related to those notifications in the database of the Authority and inform the relevant unit. 
  • To submit the developments in specified markets/sectors with the coordination of the relevant unit as quarterly reports to the Presidency, depending on the database of the Authority 
  • To submit a reasoned proposal to initiate a sector inquiry and to support the sector inquiry to be made in coordination with Economic Analysis and Research Department, to make analysis in collaboration with other departments for identifying the effects of Board decisions to the economy in general or to certain sectors, where necessary, or to request such analysis from the relevant units.
  • To follow Board decisions, relevant court decisions and recent developments in competition law, to ensure that tasks and proceedings are performed in compliance with Board decisions and the case law of courts; to save the information obtained with respect to the developments in the doctrine or court decisions regarding subjects under the scope of the Authority's purview in the database of the Authority in coordination with the relevant unit. 
  • In case an advanced analysis capacity is necessary according to the examinations made, to request assistance from Economic Analysis and Research Department. 
  • To follow whether Board decisions are implemented in coordination with Decisions Department, to ensure that the requirements of the relevant decisions are fulfilled depending on findings.
  • To provide technical assistance to Decisions Department, upon request, in the process of preparing reasoned decisions, to evaluate the drafts and to give opinion where necessary. 
  • To give opinion to relevant departments about information that is qualified as trade secrets during notification and publication stages for reasoned decisions.
  • To provide assistance to the documents and studies prepared for public announcements related to the subjects under the scope of its field of duty in coordination with the relevant units. 
  • To follow the opinions submitted outside the Authority in coordination with the relevant units. 
  • The head of the department assigns sufficient number of personnel to carry out the necessary examinations and inquiries and take managerial, professional and procedural measures required by the task assigned. The head of the department may refer the report and information note for inspection by two of the professional staff, may apply other measures determined at the institutional level aimed at quality assurance, and notify the professional staff concerned of the assessment in writing. The head of the department evaluate the report and the information note submitted with respect to the above-mentioned points, prepares a checklist and notifies related opinions and assessments, if any, with a proposal. 
  • While carrying out the tasks listed above, the professional staff considers institutional legislation, previous Board decisions and their effects, source legislation and enforcement, court decisions in Türkiye, the structure and the legislation in force in the relevant sector and/or market, the doctrine related to the subject of the examination where relevant, the opinions of the regulators, consumers, undertakings and associations of undertakings in the relevant market. 
  • The head of the department, to the possible extent, complies with the principle that the professional staff performs the tasks such as initial examination, information note, preliminary inquiry, preliminary examination, except for on-site inspection, alone.
